Social Security Disability Appeals Council Cases
If a Social Security administrative law judge denied your disability claim, your next step is likely to appeal to SSA’s Appeals Council. The Appeals Council can reverse an administrative law judge’s decision and award benefits or send a case back to the judge to reconsider the case and make a new decision.
The Appeals Council’s role is different depending on whether your claim has previously been reversed by a federal court. In general, you have an opportunity to ask the Appeals Council to review the unfavorable determination with a request for review or written exceptions.
There are various deadlines and legal standards that apply to these submissions, and in many cases, you must ask the Appeals Council to review your case in order to later appeal your denied claim to a federal court.
